1. Acceptance of Terms
By accessing or using IGSendMail, you agree to be bound by these Terms of Service. If you do not agree, do not use the platform. These terms constitute a legal agreement between you and IGSendMail LLC.
2. Description of Service
IGSendMail provides an email marketing platform including email campaign creation, automation workflows, subscriber management, analytics, and related services. We reserve the right to modify, suspend, or discontinue any aspect of the service with reasonable notice.
3. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your login credentials.
- You must be at least 18 years old to create an account.
- One person or legal entity per account, unless on a multi-user plan.
- You are responsible for all activity that occurs under your account.
4. Acceptable Use Policy
You agree NOT to use IGSendMail to:
- Send unsolicited bulk email (spam)
- Send emails to purchased, rented, or scraped email lists
- Send content that is illegal, harmful, threatening, abusive, harassing, defamatory, or obscene
- Send phishing emails or impersonate others
- Distribute malware, viruses, or harmful code
- Violate CAN-SPAM, GDPR, CASL, or other applicable email regulations
- Send emails related to illegal gambling, controlled substances, or fraudulent schemes
- Exceed reasonable usage limits or abuse system resources
Violation of this policy may result in immediate account termination without refund.
5. Subscriber Data and Ownership
You retain full ownership of all subscriber data you upload to IGSendMail. We act as a data processor on your behalf. You are responsible for ensuring you have proper consent to email your subscribers.
You may export your data at any time. Upon account termination, your data is retained for 30 days and then permanently deleted.
6. Payment Terms
- Paid plans are billed monthly or annually in advance.
- All prices are in US dollars.
- We accept major credit cards (Visa, Mastercard, American Express, Discover) and PayPal.
- Failed payments will trigger a grace period of 7 days before service suspension.
- Refund requests within 30 days of initial purchase are honored in full.
- No refunds are provided for partial billing periods upon cancellation.
7. Free Plan
The free plan is provided “as is” with the published limitations (1,000 subscribers, 10,000 emails/month, 3 automation workflows). We reserve the right to modify free plan features and limits with 30 days notice.
Free accounts that remain inactive for 12 consecutive months may be archived.
8. Service Level
We target 99.9% platform uptime. Scheduled maintenance will be communicated at least 48 hours in advance.
We are not liable for downtime caused by factors outside our reasonable control, including internet outages, third-party service failures, natural disasters, or force majeure events.
9. Intellectual Property
IGSendMail and its original content, features, and functionality are owned by IGSendMail LLC and protected by copyright, trademark, and other intellectual property laws.
Email templates and content you create using our platform belong to you. You grant us no rights to your content beyond what is necessary to provide the service.
10. Limitation of Liability
To the maximum extent permitted by law, IGSendMail shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or business opportunities, arising from your use of the service.
Our total liability for any claim arising from these terms or your use of the service shall not exceed the total amount you paid to IGSendMail in the 12 months preceding the claim.
11. Indemnification
You agree to indemnify and hold harmless IGSendMail, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the service, your violation of these terms, or your violation of any third-party rights.
12. Termination
You may cancel your account at any time from your account settings. We may terminate or suspend your account for violation of these terms, with or without notice depending on the severity of the violation.
Upon termination, your right to use the service ceases immediately. Provisions regarding liability, indemnification, intellectual property, and dispute resolution survive termination.
13. Dispute Resolution
These terms are governed by the laws of the United States. Any disputes arising from these terms shall first be attempted to be resolved through good-faith negotiation for a period of 30 days.
If negotiation fails, disputes shall be submitted to binding arbitration. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.
14. Modifications to Terms
We may update these Terms of Service at any time. Material changes will be communicated via email at least 30 days before they take effect. Continued use of the service after the effective date of changes constitutes acceptance of the updated terms.
