    AutomateNexus LLC d/b/a IGSendMail provides a cloud-based email marketing platform providing email campaign creation, subscriber list management, marketing automation workflows, email deliverability tools, built-in email verification, analytics and reporting, template design, API access for programmatic email sending and list management, and white-label reseller capabilities enabling customers to offer email marketing services under their own brand.

    We reserve the right to modify, suspend, or discontinue any part of the services at any time with or without notice.

    3. User Responsibilities

    By using our services you agree to:

    7. Termination

    AutomateNexus LLC d/b/a IGSendMail may suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms or if continued access may cause harm to AutomateNexus LLC d/b/a IGSendMail or other users. Upon termination, all rights granted under these Terms will immediately cease.

    8. Limitation of Liability

    To the maximum extent permitted by law, AutomateNexus LLC d/b/a IGSendMail will not be liable for any indirect, incidental, consequential or punitive damages, including loss of profits, data, or revenue, arising out of your use of the Services. In any case, AutomateNexus LLC d/b/a IGSendMail's total liability shall not exceed the amount you paid in the twelve (12) months prior to the claim.

    You agree to indemnify and hold harmless AutomateNexus LLC d/b/a IGSendMail, its affiliates, directors and employees from any claims, damages, or expenses arising from your misuse of the Services or breach of these Terms.

    10. Governing Law and Jurisdiction

    These Terms are governed by and construed in accordance with the laws of the State of Washington, United States. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in Washington, United States.
